TERMS OF SERVICE

Effective Date: October 16, 2026

1. Agreement and Scope

These Terms of Service (“Terms”) govern Services provided by Tennis Central Corp (“Tennis Central,” “we,” “us,” or “our”), including our websites and other digital properties that we own or control and that reference these Terms.

“Services” include adult and youth instruction, private and group lessons, memberships, installment-payment arrangements, court reservations, camps, tryouts, team activities, competitions, domestic and international travel experiences, college-placement assistance, facility and program management, home-court services, racquet services, apparel, equipment, retail sales, photography, video, performance analysis, accounts, applications, and customer communications.

“You” means the person accepting these Terms and, where applicable, an authorized parent or guardian acting for a minor participant.

You agree to these Terms when they are presented for acceptance and you affirmatively accept them through a checkbox, appropriately labeled registration or purchase action, electronic signature, or another legally sufficient method. Merely receiving marketing or visiting a page does not independently authorize payment, recurring billing, publicity, or a participant release.

Existing purchases and signed agreements remain subject to their applicable terms unless lawfully amended.

2. Eligibility and Parent or Guardian Authority

An adult accepting a purchase, membership, participation agreement, or financial obligation must have legal capacity to contract.

A parent or legal guardian must authorize enrollment and participation for a minor. The accepting adult represents that they have the authority to provide the applicable permissions and accepts the obligations expressly undertaken in that capacity.

Children younger than 13 may not independently create accounts, submit forms, or enroll in electronic communications. A permitted account for a participant aged 13 through 17 requires appropriate parent or guardian authorization.

A child’s account access does not independently authorize purchases, travel, medical treatment, publicity, or other activities requiring separate permission.

If you register another adult, you must have authority to make the booking and provide their information. You may not sign a participant release or consent for another person without legally sufficient authority.

3. Relationship to Other Agreements

For contractual matters, the following order of precedence applies:

  1. A separately signed participant, medical, media, membership, or travel agreement.

  2. Program-specific registration terms provided before enrollment or purchase.

  3. These Terms.

A more specific signed agreement governs a conflict concerning its relevant subject. An agreement addressing one subject does not automatically override an unrelated protection or permission requirement.

Mandatory law prevails over conflicting contract language.

Our Privacy Policy governs the processing described there. These Terms do not expand information uses beyond applicable notices and permissions.

4. Electronic Acceptance, Records, and Notices

Electronic acceptance and signatures may have the same effect as paper signatures where legally recognized.

We may provide confirmations, invoices, agreements, and other records electronically using the contact information you provide. Where law requires particular consent to electronic delivery, that consent must be obtained through the applicable process.

You should retain copies of accepted agreements and transaction records. You may request a copy, ask about paper delivery, update your contact details, or withdraw consent to electronic delivery by contacting us. Withdrawal applies prospectively and does not invalidate previously effective records.

Electronic access generally requires an internet-connected device, a compatible browser or application, an active email account where email is used, and the ability to view and retain the relevant record. Material changes affecting access to required electronic records will be addressed as required by law.

5. Accounts and Registration Information

You must provide accurate information and keep relevant contact, participant, emergency, and payment information current.

You are responsible for protecting your credentials and for activity you authorize through your account. Notify us promptly of suspected misuse. You are not automatically responsible for unauthorized activity where law provides otherwise.

Do not:

  • Impersonate another person or misrepresent age or authority.

  • Share access in a way that compromises a participant’s privacy or safety.

  • Access another customer’s account without permission.

  • Circumvent security, eligibility, booking, or payment restrictions.

We may require reasonable verification before changing sensitive account information, releasing records, or acting on disputed instructions.

6. Service Descriptions and Availability

Available Services, locations, prices, eligibility requirements, schedules, and included benefits vary.

The applicable offer or registration materials should identify material terms before purchase. A reference to a possible service does not guarantee that it is currently available.

We may correct errors and update prospective offers. An error does not permit us to disregard an accepted purchase or binding representation without an appropriate lawful remedy.

7. Bookings, Reservations, and Attendance

A booking is confirmed through the applicable confirmation process. An inquiry, waitlist request, or unaccepted scheduling request does not guarantee a place.

You must satisfy disclosed registration, payment, eligibility, and permission requirements. Court access and program participation may be limited by capacity, facility rules, maintenance, or safety conditions.

Arrive ready to participate at the scheduled time. A late arrival ordinarily does not extend a lesson or reservation beyond its scheduled end. If our delay materially reduces the purchased Service, we will provide an appropriate adjustment.

Do not attend a different session, substitute another participant, transfer a booking, or use membership benefits for an ineligible person without authorization.

8. Lessons, Programs, and Packages

Instructional format, session length, group size, experience level, location, and package benefits are governed by the accepted offer and applicable registration terms.

Group instruction involves shared coaching time. Individual attention and progression vary with attendance, experience, effort, health, and group needs.

Package expiration dates, transfer restrictions, and usage conditions apply only when properly disclosed and legally permitted. A package does not renew automatically merely because a payment method is saved.

We may recommend a more appropriate level or group for safety and effective instruction. A material change to a purchased program will be handled under Section 14.

9. Prices, Taxes, and Fees

You are responsible for the agreed price and applicable taxes and fees disclosed before purchase.

No late fee, processing fee, cancellation fee, collection charge, or other additional charge is imposed solely because it could fall within a general category mentioned in these Terms. Such charges must be lawful, applicable, and properly disclosed.

Discounts and promotions are subject to their disclosed eligibility and duration. A promotional rate does not establish a permanent price.

10. Payments and Saved Payment Methods

You must have authority to use the payment method provided.

Payment authorization extends only to the transaction, payment schedule, recurring arrangement, or additional charge you expressly authorize. These Terms do not create unrestricted permission to charge a saved method.

Payment service providers may securely retain credentials and supply tokens or limited payment details for authorized transactions. Any use of account-update services or alternative payment methods remains subject to the applicable authorization and law.

If an authorized payment fails, we may request an updated method, make permitted payment attempts, or suspend unpaid future Services after appropriate notice. We will not impose undisclosed penalties.

Contact us promptly about a suspected billing error. Nothing requires you to waive statutory billing-dispute rights, bank protections, or lawful chargeback rights.

11. Memberships and Automatic Renewal

Membership terms differ. The applicable offer and agreement must identify the price, billing frequency, initial term, benefits, renewal arrangement, minimum commitment if any, and cancellation procedure.

A membership renews automatically only when the renewal terms are clearly disclosed and you affirmatively agree to them. Saving a card, purchasing a lesson, or accepting general website Terms does not independently establish automatic-renewal consent.

For an authorized renewing membership:

  • Charges occur according to the disclosed schedule.

  • Renewal continues only under the accepted renewal arrangement.

  • We provide required acknowledgments and renewal or trial-expiration notices.

  • Material price or benefit changes require advance notice and any additional consent required by law.

  • You must have a reasonable opportunity to cancel before a prospective change becomes binding.

A fixed-term membership without an accepted renewal provision ends according to its stated term.

11.1 Canceling renewal

You may cancel automatic renewal through an available account cancellation control or by emailing booking@tenniscentral.net with enough information to identify the membership and clearly request cancellation. You may also call 202-478-9655 or use another cancellation method required by law.

For online enrollment, an accessible online cancellation method must be provided without requiring an unnecessary retention conversation or unreasonable obstacles. A clear cancellation email does not require our discretionary approval to be effective.

Unless a different lawful arrangement was clearly disclosed and accepted, cancellation prevents the next renewal when received before that renewal is processed and takes effect at the end of the current paid term. Mandatory cancellation and refund rights may require an earlier effective date.

We will confirm cancellation. Failure to receive confirmation does not invalidate a timely, properly submitted request.

11.2 Freezes and termination

Freeze eligibility, duration, fees, and billing effects depend on the applicable agreement or a specific arrangement we approve. Requesting a freeze does not itself establish one.

Any minimum commitment or early-termination obligation must be clearly disclosed and accepted. Applicable rights involving disability, relocation, facility closure, or other legally protected circumstances remain available.

12. Installment Plans

An installment arrangement may divide the price of a defined program or service into scheduled payments. It is distinct from a membership that purchases a new period of service with each renewal.

The accepted installment agreement must disclose the total price, number and timing of payments, and applicable cancellation or refund terms.

Stopping attendance does not by itself eliminate an otherwise lawful obligation to pay for a committed program. Conversely, an installment schedule does not eliminate applicable cancellation, refund, or consumer-credit rights.

Withdrawal of automatic-payment authorization does not necessarily cancel an underlying lawful debt. We will address another payment method where appropriate. It does not authorize further debits contrary to law or the withdrawal.

13. Customer Cancellations, Rescheduling, Refunds, and Credits

Specific registration terms and signed agreements govern when they validly establish a different rule.

For ordinary lesson bookings otherwise governed by these Terms:

  • Requests received more than 24 hours before the scheduled start may be rescheduled, subject to availability.

  • Cancellations received 24 hours or less before the start and no-shows may forfeit the booked lesson or incur the agreed lesson charge.

  • A late arrival ordinarily does not create a refund or makeup right.

  • Documented illness, injury, emergencies, and accommodation needs will be considered reasonably and consistently with applicable rights.

Send requests to booking@tenniscentral.net, use an available booking cancellation function, or use another method identified in your registration materials. An inquiry about possible cancellation should clearly state whether you are actually canceling.

Group-session, camp, tournament, court-reservation, and travel withdrawal rules may differ because of reserved capacity and committed costs. Any special deadline, forfeiture, or nonrefundable amount must be disclosed before purchase.

Credit expiration, transferability, eligible uses, and restrictions must be disclosed and lawful. We will not retroactively shorten an existing credit’s valid period.

A request for a refund is not automatically satisfied by issuing credit when law or the applicable agreement requires a monetary refund.

14. Tennis Central Cancellations and Material Changes

If we cancel a Service because of insufficient enrollment or cannot provide the purchased Service or a reasonably acceptable replacement, we will refund the unprovided portion, subject to any more favorable agreement or mandatory right.

We may make reasonable coach, instructor, court, location, or schedule substitutions that preserve the essential character and value of the Service.

If a substitution materially changes the purchased experience, we will notify affected customers and provide a reasonable option, which may include accepting the substitute, transferring, rescheduling, receiving credit, or obtaining an appropriate refund.

A general substitution clause does not permit us to retain payment for materially different or unavailable Services without an appropriate remedy.

15. Weather, Unsafe Conditions, and Facility Closures

We may suspend, relocate, modify, or cancel activities because of lightning, precipitation, extreme temperatures, air quality, unsafe surfaces, facility conditions, emergencies, or other safety concerns.

Follow instructions from coaches, facility personnel, and event officials. Do not assume a session is canceled solely because of conditions at your location; check the designated communication channel.

The applicable program terms govern permissible indoor alternatives, partial-session treatment, and makeup arrangements. Where no specific rule was disclosed, we will provide a reasonable makeup, credit, or refund proportionate to the unprovided Service and applicable circumstances.

A temporary closure does not eliminate mandatory membership or consumer refund rights.

16. Illness, Injury, Accommodations, and Emergency Response

Provide relevant participation restrictions, allergies, emergency contacts, and accommodation needs through the appropriate registration or program process.

Do not participate when doing so would create an unreasonable risk to yourself or others. Inform staff promptly of an injury or material change affecting safe participation.

We will consider reasonable accommodations consistent with applicable law and the nature of the activity. A medical clearance may be requested when reasonably justified.

Coaching and performance analysis are not medical diagnosis or treatment.

In an emergency, personnel may contact emergency services and your designated contacts and take reasonable protective steps. Separate medical authorizations govern treatment permissions. These Terms do not replace a required medical or medication-administration authorization.

Responsibility for medical expenses is determined by applicable law, insurance, and any valid agreement; this section does not excuse liability for Tennis Central’s legally actionable conduct.

17. Camps and Youth Programs

Parents and guardians must comply with disclosed arrival, pickup, authorized-release, attendance, equipment, food, medication, and supervision requirements.

Supervision begins and ends according to the program’s stated arrangements. Do not leave a child before authorized check-in or assume that supervision, transportation, swimming access, or aftercare is included unless expressly offered.

Late-pickup or aftercare charges apply only when disclosed and lawful.

A parent or guardian must remain available through the designated emergency contact arrangement. Inform us of relevant custody or pickup restrictions and provide reasonably necessary supporting documentation.

Camp activities may include appropriate off-court instruction or indoor alternatives when outdoor play is unsuitable. A substantial change remains subject to the applicable agreement and consumer rights.

Separate swimming, transportation, excursion, medical, or travel permissions may be required.

18. Tryouts, Evaluations, Teams, and Competitions

Tryout participation does not guarantee team selection, a particular role, playing time, ranking, tournament acceptance, or advancement.

Selection and evaluation may consider disclosed criteria such as ability, age, eligibility, attendance, conduct, readiness, safety, team needs, and competitive requirements.

We will not knowingly misrepresent the benefits or selection opportunities associated with a paid tryout.

Competitions may be governed by independent organizers’ eligibility, scoring, conduct, withdrawal, and refund rules disclosed through the relevant event. You are responsible for accurate eligibility information and required registrations.

Results, rankings, draws, or event information may be published as part of competition administration, subject to applicable privacy and permission requirements.

19. Domestic and International Travel

Travel experiences require trip-specific information and, where applicable, a separate signed travel agreement.

Before payment, the applicable offer should identify Tennis Central’s role, material inclusions and exclusions, payment schedule, cancellation terms, committed third-party costs, and any required insurance or permissions.

Tennis Central may act as an organizer, service provider, booking intermediary, or referral source depending on the particular offer. The offer must identify the relevant role; these Terms do not characterize every trip as the same arrangement.

Participants and families are responsible for obtaining required passports, visas, entry permissions, health documents, and legally sufficient minor-travel consent unless a specific agreement assigns a task to us.

Transportation, lodging, excursions, and competitions may be supplied by independent businesses. Their lawful, properly disclosed terms apply to their own services. That does not eliminate obligations Tennis Central undertakes as seller or organizer.

For minors:

  • A parent or guardian must execute required travel and medical permissions.

  • Chaperoning, transportation, rooming, supervision, and communication arrangements must be specified.

  • Purchase alone does not authorize a child’s international travel.

Itineraries may change for safety, operational, or external reasons. Material changes, cancellations, recoverable payments, and properly disclosed nonrecoverable costs are addressed under the travel agreement and applicable law.

Travel insurance, if required or offered, is subject to its actual coverage terms and exclusions. It does not guarantee reimbursement.

20. College-Placement Assistance

College-placement and recruiting assistance may include advising, evaluations, introductions, athletic profiles, recruiting videos, and application-related support.

Colleges, coaches, governing organizations, and scholarship administrators make their own decisions. We do not guarantee admission, recruitment, team selection, roster status, eligibility, financial aid, scholarships, or any particular financial outcome.

Past results do not establish future results.

You are responsible for accurate academic, athletic, eligibility, and application information and for meeting deadlines unless the accepted agreement expressly assigns a task to us.

A general disclaimer does not excuse a specific binding commitment, misrepresentation, or failure to provide contracted Services.

21. Retail Sales, Shipping, and Returns

Product descriptions and accepted purchase terms identify the merchandise, price, availability, and material specifications.

We will ship within the promised period or comply with applicable delay-notice, consent, cancellation, and refund requirements. If merchandise cannot be supplied, we will provide the remedy required by law.

Unless a lawful, different return policy was disclosed before purchase, unused standard merchandise may be returned within 30 days after receipt, with proof of purchase and original packaging reasonably available.

Contact booking@tenniscentral.net for return instructions. For a change-of-mind return, you are responsible for reasonable return-shipping costs unless otherwise agreed. We will address reasonable return costs for defective, damaged, or incorrectly supplied merchandise.

Custom, personalized, or altered items may become noncancelable or nonreturnable after authorized work begins, as disclosed before purchase. This does not eliminate remedies for defects, incorrect work, or failure to meet the agreed specifications.

Unless otherwise required by law or a more favorable accepted agreement, risk of loss for merchandise we ship remains with us until delivery to you or your authorized recipient.

Manufacturer warranties may apply in addition to nonwaivable consumer rights.

22. Racquet Services and Customer-Owned Equipment

Racquet services are performed according to the accepted work order, including the requested materials, specifications, price, and any completion commitment.

Inform us of known damage, prior modifications, unusual requirements, or material sensitivities. We may decline work that cannot reasonably be performed safely.

Customization involves changes in feel and performance; individual results vary. It is not a medical treatment or a guarantee against injury.

A specific completion promise remains subject to its actual terms and applicable remedies. We will communicate material delays.

We will exercise reasonable care with customer-owned equipment. These Terms do not excuse damage caused by our failure to exercise legally required care.

Uncollected equipment will be handled according to applicable notice and property laws. We do not acquire ownership merely because a customer misses a pickup date.

23. Home-Court and Facility Services

Home-court coaching, events, management, maintenance, construction, repair, or other work requires an appropriate service description or separate agreement.

The person arranging access must have authority to use the property and authorize the requested activity. Disclose known hazards and provide reasonably safe access.

Construction, alterations, specialized maintenance, permitting, inspection responsibilities, and contractor work must be addressed in a specific written scope. General website Terms do not authorize physical work or represent that every professional service is performed directly by Tennis Central.

Facility owners’ rules and access restrictions may apply, subject to the Services Tennis Central has agreed to provide.

24. Athletic and Recreational Risks

Tennis, exercise, competition, travel, and recreational activities involve risks that can include serious injury, permanent disability, and death.

Risks include falls, collisions, repetitive strain, exertion, dehydration, heat illness, weather, playing surfaces, equipment, ball or racquet impacts, infectious illness, transportation, unfamiliar locations, and the conduct of other people.

Instruction and precautions cannot eliminate every inherent risk. Participants must follow safety instructions, use appropriate equipment, respect personal limitations, and report unsafe conditions.

Participation is voluntary, and participants accept the inherent risks of their chosen activities to the extent permitted by law.

These Terms do not themselves constitute a separately executed release of negligence claims, medical authorization, or travel consent. Any separate waiver is enforceable only to the extent permitted by the applicable jurisdiction.

Nothing here releases a claim that cannot lawfully be released, including a minor’s claim where parental release is prohibited.

25. Participant, Parent, and Spectator Conduct

Participants, parents, guardians, and spectators must:

  • Follow reasonable safety instructions and facility rules.

  • Treat others respectfully.

  • Refrain from harassment, discrimination, threats, violence, exploitation, and abusive conduct.

  • Respect youth-safeguarding and communication requirements.

  • Avoid unauthorized coaching, commercial activity, or access.

  • Respect property, equipment, privacy, and other participants’ information.

  • Refrain from intoxication or substance use that makes participation unsafe or unlawful.

  • Report credible safety or safeguarding concerns promptly.

Do not photograph, record, contact, or publicize another participant in violation of law, applicable permission requirements, or reasonable facility and program rules.

26. Photography, Video, and Performance Analysis

Instructional recordings, recruiting materials, competition coverage, and promotional publicity are subject to the applicable purpose and permissions.

These Terms do not grant blanket permission to use your or a child’s identity, likeness, voice, or testimonial in advertising. Promotional use requires the relevant separate release or permission.

Performance analysis supports coaching and evaluation. It does not guarantee improvement or competitive results and is not medical advice.

We do not use recordings for biometric identification or authorize identifiable customer material for general-purpose AI training.

Privacy and withdrawal requests are addressed under our Privacy Policy and any applicable release.

27. Text Messaging Terms

27.1 Sender and message types

Tennis Central Corp is the sender of messages under its messaging programs.

If you enroll, messages may include inquiry responses, booking confirmations, reminders, schedule and weather changes, billing notices, program updates, and separately authorized promotions.

Messages may use automated technology where lawful and within the permission provided.

27.2 Voluntary marketing consent

Marketing-text consent is optional and is not a condition of purchasing any product or Service.

Providing a telephone number, accepting these Terms, or registering for a program does not alone constitute consent to automated marketing texts.

Necessary service communications can be arranged through another practical channel when texting is declined or withdrawn.

27.3 Frequency and charges

Marketing messaging is limited to up to four promotional texts per calendar month unless you separately agree to a different clearly disclosed program.

Service-message frequency varies with bookings, participation, account activity, and conversations you initiate.

Message and data rates may apply. Your wireless plan determines applicable charges.

27.4 STOP and other revocations

Reply STOP to a program message to opt out where replies are supported. Clear requests using ordinary language, such as “unsubscribe,” “cancel,” or “please stop texting,” will also be honored.

You may revoke consent through another reasonable method, including emailing booking@tenniscentral.net, calling 202-478-9655, or clearly communicating the request to an appropriate Tennis Central representative.

We do not require one exclusive revocation method. For a number that cannot accept replies, an accessible alternative will be disclosed.

Requests are processed as soon as practicable and no later than the applicable legal deadline, which will not exceed ten business days where that period applies. A shorter legally required deadline controls.

We may send one nonpromotional opt-out confirmation where permitted. After opt-out, we will not send further messages within its scope except communications separately requested or otherwise lawfully permitted.

Opting out of texts does not cancel a reservation, membership, or payment obligation. Contact us separately to cancel the underlying Service.

27.5 HELP and support

Reply HELP where supported, email booking@tenniscentral.net, or call 202-478-9655 for assistance.

27.6 Re-enrollment

After opting out, you may re-enroll through a supported affirmative opt-in process. A new inquiry or purchase does not automatically restore marketing consent.

27.7 Telephone-number accuracy

Provide an accurate number that you are authorized to use. Notify us promptly if it changes, is deactivated, or is reassigned.

Do not enroll another person’s number without appropriate authority and consent.

27.8 Eligibility and minors

Marketing messaging is intended for adults aged 18 or older.

Direct nonmarketing messaging with a teen participant requires appropriate parental authorization and applicable safeguarding arrangements. Children younger than 13 must receive communications through a parent or guardian rather than independently enrolling.

27.9 Delivery and carriers

Delivery is not guaranteed and may be delayed, blocked, or unavailable because of network conditions, device settings, carrier restrictions, or other factors.

Wireless carriers are not liable for delayed or undelivered messages to the extent permitted by law. This provision does not waive nonwaivable rights.

Do not rely exclusively on text messages for emergency assistance or time-sensitive safety information.

27.10 Privacy and program changes

Our Privacy Policy explains messaging information practices. Mobile opt-in information and consent records are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.

We may modify or end a messaging program with appropriate notice. Material changes in message purpose, sender, or consent scope require fresh consent where applicable; a general Terms update does not supply that consent.

28. User-Submitted Content and Feedback

You retain ownership of content you submit, subject to any rights held by others.

You grant Tennis Central a limited, nonexclusive license to host, reproduce, transmit, display, and adapt submitted content only as reasonably necessary to provide the requested Service, follow your instructions, and maintain appropriate records.

This license does not independently authorize advertising use, sale of personal information, or unrelated AI training.

You must have the rights and permissions needed to submit content. Do not submit unlawful, infringing, abusive, deceptive, or privacy-invasive material.

We may moderate or remove content that violates these Terms or creates a reasonable safety, privacy, or legal concern.

We may use voluntarily provided suggestions to improve Services without an obligation to compensate you, but this does not grant publicity rights or ownership of separately identified protected materials.

29. Intellectual Property and Digital-Service Restrictions

Tennis Central’s original website materials, instructional materials, branding, and other protected content belong to Tennis Central or its licensors.

You may use materials supplied to you for their intended personal or authorized program purpose. Do not reproduce, distribute, sell, or exploit protected materials beyond that permission or rights provided by law.

Do not introduce malicious code, disrupt systems, scrape personal information, bypass access controls, or use digital Services unlawfully.

30. Third-Party Facilities and Services

Independent facilities, sports organizations, payment services, travel businesses, and other providers may impose lawful terms concerning their own products and activities.

A link, recommendation, shared location, or booking connection does not necessarily establish ownership, agency, or control.

We remain responsible for obligations we expressly undertake and for liability imposed by law. Describing a provider as independent does not excuse Tennis Central’s own actionable conduct.

31. Suspension and Termination

We may restrict an account or suspend participation when reasonably necessary to address credible safety or safeguarding concerns, fraud, unauthorized access, serious misconduct, or nonpayment.

Immediate protective action may be appropriate for urgent concerns. For ordinary remediable breaches, we will provide reasonable notice and an opportunity to correct the issue where practicable.

Permanent termination and treatment of prepaid amounts will depend on the reason, Services delivered, applicable agreements, and law. We will not automatically confiscate all unused payments solely because an account is closed.

Termination does not erase accrued lawful obligations or eliminate applicable refund, privacy, or dispute rights.

32. Disclaimers and No Guaranteed Outcomes

We provide coaching and related Services with the care required by applicable law.

Athletic development, competition, team selection, recruiting, admission, scholarships, and travel experiences depend on circumstances outside our control. We do not guarantee particular outcomes except to the extent of a specific binding commitment.

Digital Services are provided on an available basis. We do not guarantee uninterrupted access or that every technical error can be prevented.

To the extent permitted by law, implied warranties concerning general website functionality are disclaimed. This does not disclaim nonwaivable consumer warranties, obligations to deliver purchased Services, or duties of reasonable care.

33. Limitation of Liability

To the extent permitted by law, Tennis Central is not liable for indirect, special, incidental, or consequential economic losses that were not reasonably foreseeable when the relevant agreement was made.

For claims that may lawfully be limited, aggregate liability arising from the affected Service will not exceed the greater of $100 or the amount you paid Tennis Central for that affected Service during the preceding twelve months.

These limitations do not apply to fraud, intentional misconduct, gross negligence, reckless conduct, personal injury or death caused by our negligence, or liability or remedies that cannot lawfully be excluded or limited.

They do not reduce a required refund or permit us to retain payment for Services we are legally obligated to refund.

A separate lawful agreement may establish different protections for its particular subject.

34. Responsibility for Third-Party Claims

To the extent permitted by law, you are responsible for third-party claims and reasonable resulting costs caused by your intentional unlawful conduct, knowing infringement of another person’s rights, or materially false representation of authority.

Any responsibility is limited to the extent your conduct caused the claim. It does not require indemnification for Tennis Central’s negligence or other actionable misconduct.

A parent or guardian is not required by this section to indemnify Tennis Central against a minor’s personal-injury claim or otherwise circumvent protections applicable to minors.

We will provide reasonable notice of a covered claim and an appropriate opportunity to participate in its defense. No settlement imposing an admission or nonmonetary obligation on you may be made without your consent.

35. Events Beyond Reasonable Control

Events beyond reasonable control may interrupt Services, including severe weather, disasters, public emergencies, government restrictions, transportation disruptions, and unavoidable facility failures.

We will take reasonable steps to communicate and mitigate disruption.

This section does not eliminate statutory rights or automatically convert every payment into nonrefundable credit. Rescheduling, credits, refunds, and any properly disclosed nonrecoverable travel costs remain governed by the applicable agreement and law.

36. Mandatory Consumer Rights

Nothing in these Terms removes a nonwaivable right concerning refunds, automatic renewal, consumer credit, health-club or recreational-service contracts, disability, relocation, death, facility closure, merchandise, privacy, or communications.

If a transaction is subject to a statutory cooling-off or cancellation period, that right applies in addition to any contractual cancellation option.

Where a specific contract, notice, registration, or cancellation disclosure is legally required, general website Terms do not replace it.

We accept cancellation through the methods provided here in addition to any method that applicable law requires us to honor.

37. Governing Law and Disputes

D.C. law governs these Terms except where federal law or mandatory protections of another applicable jurisdiction control. This choice does not deprive a consumer of nonwaivable rights.

Before filing an ordinary contractual claim, either party should send a written description of the dispute and requested resolution to the other party and allow 30 days for good-faith informal resolution.

Send notices to booking@tenniscentral.net or the mailing address in Section 41. We will send a notice to your appropriate contact information.

The informal process does not prevent timely filing to preserve a limitation period, seeking urgent protective relief, contacting a regulator, exercising a billing right, or using an available small-claims process.

Unresolved disputes may be brought in a court with competent jurisdiction. D.C. courts are an agreed forum where legally enforceable; a consumer may use another forum when mandatory law requires or permits it.

These Terms do not require arbitration or waive a right to a jury trial or participation in a class proceeding. A separate, validly accepted agreement may address dispute procedures for its particular subject.

38. Changes to These Terms

We may update these Terms prospectively by revising the effective date and providing appropriate notice.

Material changes to an existing agreement require the notice and acceptance required by that agreement and applicable law. Posting revised website Terms does not retroactively change an accepted price, cancellation rule, participant release, or dispute arrangement.

New recurring-charge obligations, marketing permissions, publicity rights, or materially different information uses require the applicable separate authorization.

39. General Provisions

If a provision is unenforceable, it will be limited or severed to the extent permitted, while the remaining provisions continue where they can reasonably operate.

Failure to enforce a provision on one occasion is not a permanent waiver.

You may not transfer a personal booking, membership, or account contrary to its accepted restrictions. Tennis Central may assign an agreement in connection with a legitimate business transfer only where lawful and without eliminating accrued rights or materially reducing promised protections.

These Terms, applicable accepted registration terms, and relevant signed agreements form the agreement concerning their subject. They do not exclude liability for fraud, actionable misrepresentation, or binding commitments that applicable law preserves.

Provisions that reasonably require continuing effect—including payment obligations already accrued, intellectual-property protections, lawful liability provisions, and dispute terms—survive termination to the appropriate extent.

40. Notices and Customer Communications

Keep your contact information current and review confirmations and program communications.

Ordinary service notices may be delivered through agreed email, account, application, or other appropriate channels. Required formal notices will be delivered in the manner applicable law or the relevant agreement requires.

Marketing consent is separate from consent to necessary service communications. Withdrawal of one communication permission does not itself change an unrelated booking or agreement.
